Terms and Conditions

These terms and conditions are the terms and conditions upon which we make the website available to you and any of our services which are accessible on or via kbloomingflowers.com. These Terms and Conditions govern your use of the Site and K-Blooming Flowers LLC Services.

  1. Products

1.1 All products as depicted on our website (as may be varied from time to time) are available in Minnesota State

1.3 All our products are subject to availability. In the event of supply difficulties, we have the right to substitute with a product of equivalent value and quality without notice.

1.4 If we are unable to supply all or part of your order (the product or any substitute product), we will notify you as soon as possible and reimburse your payment in full no later than 5 days after the intended delivery date.

1.5 Products are delivered next day unless other delivery date or service is selected.

1.6 Certain selected products might not be available for same day delivery or other special delivery services. We will present further information regarding product availability and delivery options when placing your order.

  1. Prices

2.1 Prices listed  on our website are valid for a maximum of 10 days of submitting your purchase form.

  1. Orders / Payment

3.1 We will provide you with clear instructions to navigate the order process and you will be required to provide us with your complete personal details, including accurate area code, together with those of the intended recipient and all necessary payment details.

3.2 We accept payment by all major credit and/or debit cards and PayPall.

3.3 By submitting your order you accept the offer. An email with a confirmation of your order details will be send to you, in order to advise that we are processing the order via the email address you provided us with. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.

3.4 When clicking on the ‘check out’ button at the end of the order process, you agree to our Terms and Conditions and appearing anywhere K-Blooming Flowers site.

3.5 We cannot accept orders from customers under the age of eighteen (18) years.

  1. Delivery

4.2 The products you select are not available for delivery to certain areas – where possible we will let you know of these restrictions prior placing your order.

4.3 The delivery date, you have chosen will be confirmed in your email order confirmation. Orders placed on Sundays or Public Holidays will be dealt with the next working day.

4.4 We aim to put every effort to deliver on the date chosen, but the exact delivery time cannot be guaranteed.

4.5 In order to avoid problems with delivery, please make sure that you have included the full address details, including accurate are code of the intended recipient and telephone number, together with your daytime contact telephone number or e-mail address so that we can notify you in the event that any delivery problems are encountered.

4.6 In the case of delivery to certain locations, where a third party is involved, such as (offices, hospitals, airports, ships and other business locationsh), the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient.

4.7 Please note that the carrier is only responsible for delivering to the address you quote (or to a neighbour if no one is at home) we regret that where the goods have been correctly delivered we do not accept responsibility if the intended recipient has moved, or lives elsewhere, and the actual receiver refuses or fails to return item(s).

4.8 In an event where the carrier cannot find someone to accept delivery they will deliver to a neighbour, leave in a secure location or leave a card at the address for the recipient to make contact.

4.9 In case if there are difficulties in delivering your order to the intended recipient we (including the florist or third party delivering your order) reserve the right to contact the recipient using the contact details you provided at the time of placing your order.

  1. Cancellation and Refund

5.1     All fresh flower and plant orders may be cancelled or amended up to 10 hrs before the required delivery date by contacting us on 952-923-7177 or via kbloomingflowers@gmail.com

5.2 We inform you that the order you placed may not be cancelled for: (i) perishable goods once your order has been dispatched; or (ii) customised goods if at the time you seek to cancel the order, the customisation process has begun.

5.3  In case with non perishable goods you may cancel the order from the point at which you place your order until 5 calendar days after you have received your goods. In case, when you exercise your right to cancel, you will be responsible for costs of returning the goods which must be returned within 7calendar days of cancelling. You are not entitled to reimbursement of costs for enhanced delivery.

5.4  Refunds are normally processed within 7 days of receipt of goods at our shop.

Damage

2.0 We pack our flowers carefully to ensure they arrive as fresh and beautiful as when they left us, but on a small number of occasions (and for reasons beyond our control) they may get damaged in transit. In case this occurs to a level that you deem unacceptable, please do contact us so that we can arrange a free of charge replacement at our next available delivery date, or a refund. Please note that you have to send us a photo via email of the damaged flowers in question within 2 hours of receipt of the flowers if possible. If we offer you a refund, we will return you the full amount of money within 7 days.

Non Delivery

We are doing everything we can in order to deliver our flowers, but sometimes mistakes can occur and deliveries don’t turn up. If we don’t deliver your order (i.e. if your flowers have not arrived within 7 hrs of their intended delivery date) we will send you a free replacement on our next available delivery date, or a refund . In case where a refund is offered, we will refund you the full amount within 7 days.

Returns

Due to the perishable nature of flowers, we are unable to accept returns on flowers and plants. We can offer customers refunds or replacement flowers if the flowers are not delivered to an acceptable quality, as detailed in the description. For all non-perishable goods please contact directly to get a pre-paid return bag and a full refund will be completed on return of the order.

6 Complaints

6.1 Due to the perishable nature of most of our products and in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within 3 working days of the date of delivery or intended delivery of your purchase.

7 General

7.1 We have the right to supplement and amend the Terms and Conditions on which you are permitted access to K_Blooming Flowers from time to time. We will announce any changes and it is your responsibility as a customer to review our Terms and Conditions on each occasion you access K_Blooming Flowers Service. Changes will take place  (24) hours after the posting of any such change and all subsequent dealings between you and us will be based on the new terms and conditions.

7.2.These Terms and Conditions supersede any other agreement between you and us to the extent necessary to resolve any inconsistency or ambiguity between them. These Terms and Conditions will be governed by and construed in accordance with the State and Federal laws of the State of Minnesota, without giving effect to any principles of conflicts of laws. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. You agree that any claim by you (or those claiming through you) arising out of your use of this Site or material appearing on this Site, will be resolved by binding arbitration conducted in Minneapolis and shall be arbitrated on an individual basis (and not consolidated with any claim of any other party). Arbitration shall be conducted under the rules of the American Arbitration Association.
